Terms and Conditions
Saint-Gobain Building Distribution Limited trading as Jewson

1. This Promotion is only open to existing Jewson Trade Account and Jewson Trade Cash Card Account (the "Accounts") holders (the "Participants" and each a "Participant"). The Accounts do not include trade accounts or trade cash card accounts of other brands of the Promoter or Saint-Gobain Building Distribution Limited. Participants must be aged 18 or over and cannot be employees of the Promoter (or any other company within the Saint-Gobain group) (an "Employee"), an Employee's immediate family, their agents or anyone else professionally connected with this Promotion. Any Account holders which have their own Jewson account manager may not participate within this Promotion and will not be included within the definition of Participants. If there is any uncertainty as to who may be a Participant, please contact the Jewson Rewards team on 01509 410730 whose decision shall be final and binding.

2. Participants can only qualify to participate in the Promotion if they have registered and provided a valid email address on Jewsonrewards.co.uk and verify that they are over the age of eighteen (18) years old.

3. The Promoter and its third party supplier (who will be responsible for delivery of any Awards (as defined below)) reserve the right in their sole discretion to ask for evidence to verify the age, identity and/or eligibility of a Participant at any time, and to use any channels and methods available to carry out checks of any details provided, especially at the point that the Award is delivered. The Promoter may withhold delivery of the Award until it has received such evidence and failure to provide such evidence in a timely manner may result in forfeiture of the Award.

4. This Promotion will run from when a branch branded Jewson within the Promoter's network of branches (a "Branch") opens on 9th November 2020 until a Branch closes on 28th November 2020 (the "Closing Date") (the "Promotion Period"). Please see http://www.jewson.co.uk for details of branch opening times. No award will be made for any spend by a Participant after the Closing Date.

5. Subject to clause 20, if a Participant spends at least three hundred pounds (£300.00) (excluding VAT) in any single or Qualifying Transaction (see below) through an Account during the Promotion Period (a "Transaction"), they will be awarded three free bottles of wine (the "Bottle/ the "Award"). A qualifying transaction is one hundred pounds (£100) ex vat ("Qualifying Transaction"). Subject to these terms and conditions, If a Participant spends at least six hundred pounds (£600) exc vat they will be awarded six (6) bottles, nine hundred pounds (£900) they will be awarded nine (9) bottles and twelve hundred pounds (£1200) ex vat they will be awarded twelve (12) bottles. The spend can be either off line at a Branch or on the jewson.co.uk website. A Participant can only qualify for six (6) bottles from spend off line. The further six (6) bottles can be awarded through spend of six hundred (£600) on Jewson.co.uk through a Jewson credit, cash or self-build account. To qualify for an Award, the Transaction order must be collected from a Branch or a click and collect order from the Jewson.co.uk website. Delivered orders and direct to site deliveries by the Promoter's third party supplier are excluded from this Promotion. In any Transaction, a Participant's spend will be rounded down to the nearest one hundred pounds (£100) and any spend over and above this will not carry over to a following Transaction. A maximum of twelve (12) Bottles may be awarded to a Participant (no matter how many Accounts they have or how many Transactions they make) during the Promotion Period.

6. On or around Wednesday 2nd December, all Participants who qualify for an Award will be sent an email confirming the value of the Award*

7. If a Participant requires a refund on any spend made during the Promotion Period that resulted in an Award, the Promoter will deduct the value of the refund from the relevant Transaction value which may result in the Award no longer being made due to the subsequent Transaction value falling below the relevant multiple of one hundred pounds (£100).

8. If you are making a purchase through an Account but you are not the named Account holder, any Award made during the Promotion Period is for the benefit of and will be sent to the address of the Account holder.

9. The Bottles will be either a three Gables Chenin Sauvignon 2016 from South Africa ("White") or Hielo y Fuego Merlot 2019 from Chilie ("Red") and will be awarded in the following format:

10. No cash alternative is available.

11. The Bottles will be awarded whilst stocks last. In the event that stocks of the Bottles run out, the Promoter may make an alternative Award of the same colour of wine and of a similar value.

12. All Awards awarded to a Participant during the Promotional Period will be delivered together to the address of the relevant Account holder by the Promotor's third party supplier following the Closing Date. The Promoter's intention is to arrange for the Award to be delivered as soon as is reasonably possible following the Closing Date but at least prior to 31 January 2021 (no deliveries will be made between 24th December 2020 and 1st January 2021 (inclusive)). The Promoter and its agents will not be liable where an Award has been lost or stolen following delivery and such Award will not be replaced.

13. In relation to this Promotion:
a. Nothing in these terms and conditions shall exclude or limit the Promoter's or its third party supplier's liability for death or personal injury caused by their staff or supplier's negligence or for fraud.
b. Subject to 13a, the Promoter does not accept responsibility for any fault, malfunction, damage, loss or disappointment suffered by a Participant howsoever arising from accepting any Award whether due to any error, omission or other cause by the Promoter or its employees, agents or others.
c. Subject to 13a, the Promoter is not responsible for any damage or loss caused to a Participant (i) which is not reasonably foreseeable to the Participant and to the Promoter when the Participant agrees to these terms and conditions (which occurs automatically when the Participant participates in this Promotion) or (ii) is reasonably foreseeable to the Participant and to the Promoter when the Participant agrees to these terms and conditions but is only indirectly related to the Participant participating in this Promotion.
d. Subject to 13a, the Promoter reserves the right to amend any element of this Promotion, or foreclose this Promotion and cannot be held responsible for failure to deliver for reasons beyond its reasonable control, including but not limited to strike, lock-out, labour dispute, illness, act of God, natural disaster, adverse weather conditions, war, riot, civil commotion, accident, epidemic or pandemic, malicious damage, fire, flood and/or storm, compliance with law or governmental order, rule, regulation or direction, breakdown of plant, machinery or transportation. The Promoter is not responsible for any loss or damage caused to the Participant as a result of any of these occurrences.
e. The Participant agrees to reimburse the Promoter in respect of any damages or any losses suffered by the Promoter resulting from any claim made by a third party in each case in respect of any matter arising from the Participant's participation in the Promotion in breach of these terms and conditions or from the Participant's violation of any applicable law or regulation.
f. Subject to 13a, if any details on a Participant's Account are incorrect meaning that the Promoter's third party supplier is unable to deliver an Award to the Account holder, the Promoter will use reasonable endeavours to contact the Participant and redeliver the Award but the Promoter does not accept responsibility for any inability to deliver if for whatever reason it is unable to make contact with the Participant to redeliver.

14. In the event of unforeseen circumstances, the Promoter reserves the right to offer an alternative Award of equal or greater value.

15. The Promoter may require any Participant who receives an Award to take part in future publicity.

16. The Promoter reserves the right to disqualify any Participant in the event the Promoter believes that they have contravened any of these terms and conditions and if the Promoter is aware that the Participant has a dispute regarding their Account.

17. The Promoter's decision is final and binding and no correspondence will be entered into.

18. Accepting an Award may give rise to a tax liability which will be the Participant's responsibility.

19. The Promoter will only process your personal information in accordance with current UK data protection legislation and asset out in the Promoter's privacy policy at https://www.saint-gobain.co.uk/privacy-statement.

20. If for whatever reason after registering for the Promotion you then decide you do not wish to take part in this Promotion or you wish to select Love2Shop vouchers ("Vouchers") in lieu of the Bottles, you may opt out by calling 01509 410730 or emailing info@jewsonrewards.co.uk with your company name, Jewson account number and post code or by making staff at the Branch aware in writing of these details. or the fact that you do not wish to take part in this Promotion.**

21. The terms and conditions of any third party supplier will also apply to the Award where applicable. If there is a conflict between third party terms and conditions and these Promotion Terms and Conditions, these terms and conditions shall take precedence.

22. English law applies and the exclusive jurisdiction of the English Courts shall prevail.

*Participants based in Scotland and/or purchasing from a Branch in Scotland must validate their Award on receipt of an email from the Promoter. If Participants living in Scotland do not validate their Award, the Promoter reserves the right to withhold any Award.

**If a Participant opts out of receiving the Bottles, Vouchers can be selected as an as an alternative to the Award. Vouchers will be offered in the following amounts 3 bottles = £30; 6 bottles = £60; 9 bottles = £90 and 12 bottles = £120. £120 being the maximum value of the Voucher and £30 being the minimum value of the Voucher.
